Your Information. Your Rights. Our Responsibilities.
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Sky’s the Limit Health & Wellness is committed to protecting the privacy and security of your protected health information (“PHI”). This Notice describes your rights regarding your health information and our responsibilities regarding its use and disclosure.
Your Rights
You have certain rights regarding your health information. Subject to applicable law, these may include the right to:
Inspect or obtain an electronic or paper copy of your medical record and other health information we maintain about you.
Ask us to correct health information you believe is incorrect or incomplete.
Request that we communicate with you in a specific way or at a specific location.
Ask us to limit certain uses or disclosures of your health information.
Request an accounting of certain disclosures of your health information.
Obtain a paper copy of this Notice at any time.
Choose someone legally authorized to act on your behalf.
File a complaint if you believe your privacy rights have been violated.
If you paid for a healthcare service or item in full out of pocket, you may ask us not to disclose information about that service to your health insurer for payment or healthcare operations. We will honor that request unless disclosure is required by law.
Your Choices
For certain health information, you may tell us your preferences regarding what we share.
These situations may include:
Sharing information with family members, friends, caregivers, or others involved in your care.
Sharing information during disaster-relief situations.
Certain communications regarding our services.
Other uses or disclosures for which your authorization or opportunity to agree or object is required.
If you are unable to tell us your preference—for example, because you are unconscious—we may share information when permitted by law and when we determine that doing so is in your best interest.
How We May Use and Disclose Your Health Information
HIPAA permits healthcare providers to use or disclose PHI in a number of circumstances without obtaining a separate authorization.
Treatment
We may use and share your health information to provide, coordinate, or manage your healthcare and to communicate with other healthcare professionals involved in your treatment.
Payment
We may use and disclose your health information to bill and obtain payment from health plans or other entities responsible for payment.
Healthcare Operations
We may use and disclose health information to operate our practice, improve care, manage services, conduct quality activities, and perform appropriate administrative functions.
Public Health and Safety
We may disclose information for certain public-health and safety activities when permitted or required by law.
Legal Requirements
We may disclose health information when federal or state law requires us to do so.
Workers' Compensation
We may disclose health information for workers' compensation purposes as authorized by applicable law.
Health Oversight Activities
We may disclose information to appropriate health-oversight agencies for activities authorized by law.
Law Enforcement and Judicial Proceedings
We may disclose information in response to certain lawful requests, court orders, subpoenas, administrative proceedings, or law-enforcement activities when permitted or required by law.
Coroners, Medical Examiners and Funeral Directors
We may disclose health information when legally permitted for these purposes.
Other uses and disclosures not described by this Notice will generally be made only with your written authorization when authorization is required. You may revoke an authorization in writing, subject to applicable limitations.
Substance Use Disorder Records
Federal requirements concerning the confidentiality of certain substance use disorder patient records changed for HIPAA Notices of Privacy Practices in 2026. HHS's revised model NPP specifically incorporates the Part 2-related requirements.
Where applicable to records maintained or received by our practice, information subject to federal 42 CFR Part 2protections will be handled in accordance with applicable federal requirements.
Certain uses and disclosures of substance use disorder records may require your consent or authorization, and such records receive additional protections under federal law.
Note for us before launch: If your practice actually operates a federally assisted substance-use-disorder treatment program subject to Part 2, this section needs additional customization. The HHS model provides a separate Part 2 patient notice for those programs.
Our Responsibilities
Sky’s the Limit Health & Wellness is required to:
Maintain the privacy and security of your protected health information.
Follow the duties and privacy practices described in the Notice currently in effect.
Provide you with a copy of this Notice.
Notify affected individuals as required by law if a breach occurs that may compromise the privacy or security of their information.
We will not use or disclose your information other than as described in this Notice unless you authorize us in writing or another use or disclosure is permitted or required by law.
Changes to This Notice
We may change the terms of this Notice. Changes may apply to all health information we maintain, including information created or received before the change.
An updated Notice will be available upon request, at our office, and on our website.
